Thoroughbred Racing SA Stewards today concluded an inquiry adjourned from Allan Scott Park Morphettville on Saturday, 23 July 2011 with regard to the conduct of Trainer Mr. M.J. Whittle in the Scales area.

Evidence was heard from Mr. Whittle, the Clerk of Scales, an Assistant Steward and a medical expert.  Statements were tendered from a number of persons who had been present in the vicinity on the day.

Mr. Whittle was charged with offences –

1.          Under Rule AR.175(j) in that he had exhibited improper and intimidating behaviour towards an Official, namely the Clerk of Scales;  and

2.          Under Rule AR.175(p) in that -

(i)      within the Scales area he had exhibited improper conduct in generally using foul and offensive language and had generally directed foul and offensive language towards the Stewards;  and

(ii)     when in the mounting yard prior to Race 8, when asked to leave the area, did use foul language in the presence of others.

Mr. Whittle pleaded guilty to both charges.

The Stewards determined that Mr. Whittle be fined $2,500 and $2,000 with regard to the respective offences.

Mr. Whittle was informed of his right of appeal.

The Stewards also informed Mr. Whittle that as these offences occurred within the period stipulated with regard to an incident at Strathalbyn on Tuesday, 31 May 2011 in which the Trainer was found guilty of a breach of Rule AR.175(q), which resulted in a fine of $400 being imposed but suspended for a period of six months on the proviso Mr. Whittle not breach any of the Rules relating to conduct in the period, that penalty was reactivated.
