G Clarke, trainer OF JUSTICE JOHN stated that the gelding had a short let up due to injury and he endeavored to keep the horse fresh for the 1000 metre race and that may be why it failed to run on. However he did not expect the gelding to figure in the placings as in his opinion it does not perform at it’s best over the 1000 metre distance.

P Shiers stated that he had intended not to ride today, however he was declared for 2 rides including PARNAC without accepting the rides. Further that when he became aware it was Thursday morning, which did not leave sufficient time to reduce his weight to 56.0kgs. Under the circumstances stewards took no action against P Shiers.

As there was no suitable replacement rider for S Brownbill (a), BYSANTO was scratched at 2.50pm. S Brownbill (a) stated that he was unable to get his weight down despite adhering to his diet and visiting the sauna as is his normal practice.

In the early stages of the race MUCH LIKADON raced ungenerously.

Ms Boothby stated that the gelding was ridden off the pace today and that may have suited it’s style of racing. She further stated that although the gelding has ability it does not try if everything doesn’t suit and she would expect that it’s form would vary a bit

Near the 150 metres GREAT EAGLE, which was weakening was tightened for room by MR FROWN which when improving quickly took a run on the inside of HIT AND HOPE (S Leckey (a)) which rolled in. As a result GREAT EAGLE and HIT AND HOPE had to be eased. S Leckey (a) was severely reprimanded and notified that he must exercise greater care when shifting ground in future.

1st ORIGIN WARRIOR 2nd MR FROWN 3rd MANTIS

Mr S Paynter, trainer of BYSANTO lodged an official complaint in relation to that gelding carrying one kilogram overweight when it won on 16 November, 2002. Mr Paynter stated that he was unaware that M Osmond had weighed out 1 kilo overweight and if he had known he would have requested a rider change. He stated that he was in the scale area at the time the jockeys weighed out but was not informed of the overweight by the clerk of scales or M Osmond.

Stewards questioned M Osmond who stated that he had declared his riding weight as 56.0kg on the official weights and in his opinion persons engaging him to ride should be aware that he normally rides at 56.0 kgs or above. He also stated that he is aware that the clerk of scales normally asks whether the trainer is aware of any overweight but does not recall whether the question was asked on this particular occasion.

The clerk of scales, Mr B Merritt stated that, as is his normal practice, he questioned M Osmond as to whether the trainer was aware of him riding 1 kilo overweight on BYSANTO. However although he recalls Mr Paynter being in the scale area he is unsure whether he notified Mr Paynter personally.

Mr Paynter was notified that the clerk of scales on each occasion asks riders who are to be overweight as to whether the trainer is aware of them being overweight and it is normal practice for the clerk of scales to notify whoever is collecting the gear for each horse if their rider has declared overweight. Mr Paynter was further notified that this policy has been in place for sometime and that the clerk of scales will be reminded of same and will ensure that trainers or their representatives are notified of any overweight.

All winners were swabbed today.
