ACCC Poised To Probe Betfair Threats

The Premier today announced he had secured a commitment from the Australian Competition and Consumer Commission to consider a submission from the Tasmanian Government should anti-competitive retaliatory action be launched against the State over its decision to licence Betfair.

Mr Lennon met ACCC Chair Graeme Samuel in Hobart recently and outlined the State Government’s position on the persistent threats being issued against Tasmania by interstate vested interests in the racing industry.

The Premier said he was heartened by Mr Samuel’s commitment that, should those threats come to being, he would welcome a submission from the Tasmanian Government in relation to public interest issues arising from the merger of the Tabcorp and TAB Ltd businesses.

“The Tasmanian Government did not register any opposition to the merger at the time it was considered by the ACCC,” Mr Lennon said in a letter to Mr Samuel following the meeting.

“At that time, Tasmania did not see any issues that might arise that would be negative to Tasmania’s interests.

“Subsequent actions taken by other jurisdictions has, however, raised the possibility that actions could be taken in relation to the merged entity that would have a negative impact on Tasmania.

“Clearly, Tasmania expects that other jurisdictions and their statutory officers will deal equitably with this State, its industry and its publicly-owned businesses.

“However, should the Tabcorp-TAB Ltd merger in any way lead to decisions in other jurisdictions to take discriminatory action, in any form, against the Tasmanian Government, any of its businesses, or the Tasmanian racing industry, I can assure you the ACCC will receive a submission from Tasmania detailing why this merger will not prove to be in the public interest.

“I am grateful for your commitment that the ACCC would be prepared to accept such a submission from the Tasmanian Government and that the ACCC would give sympathetic consideration to reviewing its decision, announced on 23 February 2004, in relation to the merger or to taking other action under the provisions of the Trade Practices Act.”

Mr Lennon repeated that the Tasmanian Government would not be intimidated or bullied into a backflip on Betfair and that the threats from interstate vested interests in the racing industry only cemented his resolve to press ahead.

“We have a compelling case to put on integrity and probity in the racing industry, in funding to the Tasmanian racing industry and in new jobs for Tasmania,” the Premier said.

“I am confident that Members of the Legislative Council will consider these significant points when they debate the Betfair legislation.

“I am also confident in the integrity and independence of MLCs and I believe they will see these threats for what they are – a desperate attempt to preserve the status quo by those who directly benefit from the current licensing arrangements.”

PBL and Betfair Applaud Tasmania's Decision to Licence Exchanges

{SCPinterestShare href=https://www.virtualformguide.com/racing-news/tasmania/12328--sp-472029532.html layout=standard image=https://www.virtualformguide.com/images/stories/tasmania.gif desc=Betfair and PBL today welcomed Tasmanian Premier Paul Lennon’s announcement that his Cabinet had decided to introduce ground-breaking legislation next... size=small}
Betfair and PBL today welcomed Tasmanian Premier Paul Lennon’s announcement that his Cabinet had decided to introduce ground-breaking legislation next week to allow licensing of betting exchanges in Tasmania.

If passed, the legislation will enable the Betfair and PBL joint venture to apply for a licence to create the first betting exchange to operate in Australia, be regulated in Australia, and pay taxes in Australia.

“Betfair applauds the way the Government has dealt with our proposal. It has undertaken a rigorous and fair consultation process and seen through the scare tactics of our opponents. The Government has assessed our proposal on its merits, which is all we ever asked,” said Edward Wray, co-founder of Betfair.

“Our proposal to establish Betfair Australia offers tremendous opportunities for Tasmania, will introduce much needed competition into the wagering market and will provide significant support for sport and racing across the nation.”

“It is important that the racing industry prospers. Betfair’s introduction into the Australian market will help improve racing’s prosperity by attracting new punters to the sport and providing more benefits for existing punters.”

James Packer, Executive Chairman of PBL said: “Many people are scared to embrace change but those who do inevitably reap the rewards. The Lennon Government is to be congratulated. Just like the AFL did for football, it sees the benefits that technological innovation will bring to the wagering market, and it is acting to secure those benefits for Tasmania.”

“The financial guarantees we have offered are a strong sign of our confidence in both the Betfair business model and the business environment in Tasmania. We can build a partnership that creates jobs and helps secure the prosperity of racing in Tasmania.

“We are optimistic that members of both Houses of Parliament will appreciate the benefits to Tasmania of licensing Betfair Australia,” Mr Packer said.

“We will continue to make ourselves available to members of both Houses of Parliament and the three racing codes to address aspects of our proposal and what it would mean for them if Betfair is granted a licence to operate in this State,” Mr Wray said.

“Racing and sports regulators will rightly be pleased that the draft legislation will require betting exchange operators to make all betting records, including customer details, available to them in the event of an inquiry. Betfair has always wanted to provide that information lawfully and strongly supports the Government’s proposed approach.

“The social welfare and player protection initiatives that are contained in the draft legislation are strongly supported by Betfair. We have a track record in the UK of leading the industry in terms of our approach to social welfare issues and we intend to build on that reputation, and continue that work, here in Australia,” Mr Wray said.

Mr Packer said: “All in all, if the legislation is passed by the Tasmanian Parliament and Betfair Australia proceeds to obtain a licence, it will be a win-win situation. Tasmania will benefit, the racing industry will benefit, punters will benefit and Betfair Australia will benefit.”

Proposed Tasmanian Terms From Betfair

{SCPinterestShare href=https://www.virtualformguide.com/racing-news/tasmania/14201--sp-1164187484.html layout=standard image=https://www.virtualformguide.com/images/stories/tasmania.gif desc=Betfair is seeking a licence to operate its second major global hub from Australia. While it can already take bets... size=small}

Betfair is seeking a licence to operate its second major global hub from Australia. While it can already take bets from Australia under the terms of the IGA (2001), it is committed to operating under the Australian regulatory regime, whereby it can return taxes and be subject to player protection procedures required by the local government.

The Tasmanian Government has requested that the following principles form the basis of any agreement, to which Betfair has agreed. Betfair understands that the government is undertaking a consultation process with the racing industry on the basis of these terms.

  • A racing product fee based on the gross profits generated from Australian horseracing, paid irrespective of where the punter is based.
  • A tax rate based on the gross profits generated on all Australasian events (before GST, for which Betfair will be responsible), paid irrespective of where the punter is based.
  • In addition, Betfair would, for the next five years, guarantee that the Tasmanian racing industry’s funding would, at least, grow in line with inflation. If the payments outlined above proved insufficient for the current level of racing industry funding to grow in line with the CPI, Betfair would pay the necessary additional amount as a ‘top-up’ fee to ensure that it did.
  • An up-front payment (in addition to the above).

Unprecedented Checks In Betfair Agreement

{SCPinterestShare href=https://www.virtualformguide.com/racing-news/tasmania/9075--sp-729125702.html layout=standard image=https://www.virtualformguide.com/images/stories/tasmania.gif desc=The Betfair agreement takes probity arrangements on racing to new levels. The Betfair agreement takes probity arrangements on racing to new levels.

Premier Paul Lennon said anyone found to be in breach of the Tasmanian Government’s tough probity legislation would be subject to fines of up to $1 million and four years in prison.

Mr Lennon said the unprecedented new set of probity arrangements would be applied to ensure the highest standards of probity and consumer protection.

“Betfair is already available but without regulation. Our licensing agreement changes that and enforces the strictest system of probity checks anywhere in the world,” Mr Lennon said.

“The audit trail of bets on the Betfair system will log every transaction by punters.

“Race stewards will be able to identify individual registered gamblers as they lodge wagers and will be able to monitor their gambling activities.

“Even before they start using Betfair, each punter will go through an exhaustive identity and credit check before being allowed to use the system.

“So anyone attempting any form of malpractice will be identified.”

Mr Lennon said amendments to the Gaming Control Act, 1993 will protect the integrity and probity of the racing industry.

“For example, it will be a punishable offence for a person to bet with a betting exchange if the person is a direct participant in the event, such as a jockey, an owner or an AFL footballer.

“Our legislation will also eprovide for the prosecution of indirect participants where they have sought to unfairly influence a direct participant.

“We will also make provisions for people to be excluded from access to Betfair, either by their own request or through third-party application.”

Mr Lennon said the Tasmanian Government will legislate to apply the same harm minimisation initiatives to Betfair that already apply to other forms of gambling operating in the State.

Four per cent of the 15 per cent tax rate applied to all Australian events will be directed to the Community Support Levy where the winning punter is registered as a Tasmanian resident.

This equals four per cent of gross commissions, aligning Betfair’s contribution to the CSL with that applicable to gaming machines in hotels and clubs.

Other integrity and probity measures that will either be extended or included in the regulatory arrangements include:

  • Prohibiting market manipulation by operators.
  • Prohibiting punters from denying the operator from releasing relevant information about them,
  • Subjecting the operator to a range of probity regulations and prohibiting jockeys, trainers and other direct participants from using a betting exchange.

“We will also be giving full authority to stewards and officials to access all of the betting records to conduct any investigations which might be necessary,” Mr Lennon said.

“But it must be remembered that this system contains its own safeguards.

“Every punter using the system will be fully identifiable. That’s the very nature of this operation, and that will serve to make the system fully accountable.

“We will not compromise on probity and integrity.

“We will be focussing great attention on ensuring that the system is safe for the people using it, and fully and responsibly regulated.”

Mowbray to be Renamed Tasman Park

Launceston’s Mowbray racecourse is to be renamed Tasman Park under a naming rights sponsorship arrangement with meat processor Tasman Group Services.

The agreement is for an initial period of three years, with two additional two-year options.

TOTE Tasmania officially announced the sponsorship today during a launch at the venue, which holds thoroughbred, harness and greyhound racing.

The Tasman Group is Australia’s fourth largest meat processor and operates plants at Longford, King Island and Devonport and employs more than 500 people.

Tasman Group Services Managing Director Gilbert Cabral said he was impressed with TOTE Tasmania’s vision for racing in the state and for the further redevelopment of the newly named Tasman Park.

“Our new relationship with the racing industry will create significant benefits for racing clubs that use the venue and we look forward to the next three years and beyond with great anticipation,” he said.

Mr Cabral said since acquiring the Tasman Meats site at Longford, the company had invested more than $5 million for new plant and equipment and to improve existing infrastructure.

“During the next three years, further capital investment worth between $20 and $30 million is planned, which will result in an additional 100 Tasmanian jobs,” he said.

“Tasman Group has made significant investments in Tasmania and in its Tasmanian workforce, and we now want to extend that investment into the community.

“The naming rights association with the racing industry presents us with the ideal vehicle to achieve this.”

TOTE Tasmania CEO Terry Clarke said his Board was delighted that Tasman Group had chosen to support the racing industry in this way.

“TOTE Tasmania is obviously committed to improving the quality of Tasmanian racing facilities and will be extending its lease of Tasman Park until 2035, thereby ensuring a stable platform for the future of racing in northern Tasmania,” he said.

“The improvements proposed for Tasman Park will provide a multi-purpose entertainment venue for the northern community, and one I am confident Tasman Group will be proud to be associated with.

“While TOTE Tasmania and the clubs are working together on these improvements, it is important to note that Tasman Park is already home to one of Australia’s most popular regional racing events in the AAMI Launceston Cup for thoroughbreds.

“And in 2006, Tasman Park will host a heat of the Wrest Point Inter Dominion Pacing Championship and the finals of the National Sprint and Distance Championship for greyhounds,” Mr Clarke said.

Racing Minister Jim Cox said it was particularly pleasing that a major company like Tasman Group had chosen to demonstrate its commitment to the northern Tasmanian community in this way.

“Tasman Group’s commitment to technical excellence and high quality meat products, whether for domestic consumption or export, sits comfortably alongside the core Tasmanian brand values the Tasmanian Government has worked so hard to develop,” Mr Cox said.

“The relationship will create significant benefits for each of the racing clubs operating from this site and I acknowledge the work that TOTE Tasmania Chief Executive Terry Clarke has done to put this agreement together.”

Stewards questioned Jockey Michaelides (BELLE DA MOUR) as to why he elected to shift ground inwards to the middle of the track at about the 800 metres where, in the opinion of Stewards, the going was not as good as where he was travelling at the time.  Jockey Michaelides stated that the filly was not travelling well and he thought that he was making the right decision by saving some ground and also avoiding some of the heavy clods that were coming back at him.  Stewards noted Jockey Michaelides’ comments.  A post-race veterinary inspection of BELLE DA MOUR (Trainer Charles Pirotta) revealed the filly to have a slow recovery rate.

A post-race swab sample was taken from the winner of the race TARBO (Trainer John Hill).

The ARB is using a flawed report which is based on incorrect facts and ignores five years of precedent to push its agenda of keeping competition out of the wagering industry.

"Tasmanians and the racing industry should be very wary of this report," said Mark Davies of Betfair today. "It has been commissioned by people running an agenda and is based on incorrect assumptions about the UK experience with betting exchanges."

The ARB’s report ignores the Productivity Commission’s findings on the price elasticity of wagering and flies in the face of basic economic theory. Equally, its estimates of Betfair’s market share in the UK are wide of the mark, and it ignores hard evidence from both Britain and Australia. Claims in the report have been strongly disputed since its release and are contradicted in at least one recent report that was not commissioned by either of the protagonists.

The best evidence of whether Betfair has the sort of impact that the ARB suggests can be found by looking at what has happened in the UK since Betfair launched its operations in that country over 5 years ago. Betfair has clearly had no detrimental impact, given that since June 2000:

    • The UK tote has never been stronger
    • The three major bookmakers (William Hill, Ladbrokes and Coral) have all recorded record profits.
    • Total funding to the UK racing industry has doubled
    • Prize money is at record highs
    • Race-day attendances are at their highest levels since the World War II.

Betfair does not claim sole credit for the growth in prosperity of British racing but that growth does suggest that the scare campaign being run by the certain members of the ARB and others is completely misconceived.

Until the recent television rights debacle, which has clearly led to an overall decrease in wagering revenue, all major totalizators pools in Australia were experiencing strong growth. All of the evidence suggests that the Australian racing industry has much to gain and nothing to lose if Betfair is granted a licence to operate in this country.

SUPER CLAUSE (P Michaelides) stood flat-footed at the start and then tailed the field throughout.  When questioned, Jockey Michaelides reported that after being slow into stride, he felt the filly was reluctant to stride out and he felt that at this point in the race it was in his best interests to remain closer to the inside rail in an attempt to be positioned mid-field when the runners to his outside crossed back in towards the rail.  However, SUPER CLAUSE tailed the field and remained uncompetitive throughout the race.  A post‑race veterinary inspection failed to reveal any obvious abnormalities.  Trainer R Worbey will be advised that SUPER CLAUSE must trial to the satisfaction of the Stewards prior to racing again.

Just prior to entering the home straight, TED’S MEMORY (D Pires) was momentarily inconvenienced and as a result held up for a run behind GENERAL McALLISTER (S Maskiell) when that gelding shifted ground outwards.  Upon inquiry it was revealed that GENERAL McALLISTER had hung out despite the efforts of its rider, therefore, Stewards took no action against any one rider.

JOSIES DOUBLE (S Brazil) was held up for a clear run behind GENERAL McALLISTER (S Maskiell) on the home turn.

Jockey J Borrett reported that SALVATION JANE was inclined to lay in in the home straight.

RACE 6 –  XEROX TOTAL SOLUTIONS MAIDEN/CLASS 1 PLATE SET WEIGHTS – 1600 METRES

Apprentice B Bamford was reprimanded under AR-175 (k) for negligence, in that he accepted a ride on BILL’S REWARD in this race without checking with his Master to see if he had another engagement.  This resulted in him being declared as the rider of LADATAC as well as BILL’S REWARD.

The announcement of correct weight was delayed when Jockey K Moore, the rider of the second placegetter OUR BOY GEORGE, wished to view the official video patrol film.  After viewing the film, Jockey Moore advised that he wished to lodge a protest against DARK EMBRACE (J Cameron) being declared the winner on the grounds of alleged interference over the last 200 metres.  After considering evidence from all the parties concerned and viewing the official Stewards’ patrol films and acting on their own observations, the protest was dismissed as the material extent of the interference did not exceed the margin at the end of the race.  Stewards ordered the Judge’s placings to stand and correct weight was declared.  Upon inquiry, Jockey Cameron pleaded guilty to a charge of careless riding under AR-137 (a) in that from the 200 metres she had allowed her mount (DARK EMBRACE) to shift in.  When passing the 100 metre mark, OUR BOY GEORGE was subsequently taken in and eventually had to be checked by its rider over her horse’s heels.  Jockey Cameron’s licence to ride in races was suspended for a period of two race meetings in Tasmania to begin midnight 19 June 2005 and to expire at midnight on 3 July 2005.

At the start, YOULSEE (C Kingston) was slow into stride.

On entering the home straight, OUR BOY GEORGE (K Moore) was held up behind runners in front for a number of strides.

A post-race veterinary inspection of SOME CHEER (Trainer Terry Roles) revealed no obvious abnormalities.

A post-race veterinary inspection of ALWAYS SLICK (Trainer Paul E Jones) revealed no obvious abnormalities.  When questioned K Bandy (ALWAYS SLICK) explained that as the mare hangs in during her races, Trainer P Jones felt it would be better to remain close to the rail in the back straight.  However, due to the track conditions she failed to be competitive in today’s race.  Stewards noted the explanation.
