GENERAL:

Acting on a report from STC Track Supervisor Mr W Dale, licensed trainer Ms P. Webber was officially notified that on non-fast days, Wednesdays and Fridays, she must notify a delegated track official prior to galloping horses.

Supplementary Report:
Royal Randwick Saturday 10 August 2002

RACE 1: Clubs NSW / Club Keno Handicap 1400m:

Takas was fractious in the barriers.

Russell On was slow to begin.

At the start Civics ran out and hampered Mission Statement.

RACE 2: Smithfield RSL Club Handicap 1500m:

Approaching the 250m Moon Point ran out abruptly away from Fuji Cee Rocks and bumped Polar North.

RACE 4: Mounties Superfecta 1100m:

Trainer Mr P. Sutherland was fined $50 for presenting Oxford Princess in the enclosure without blinkers, part of its approved gear (AR140A).

At the start Stylish Crown shifted out causing Charlie Bub to be hampered.

At the entrance to the straight King Cappo made contact with Tom Coureuse when disappointed for a run between Tom Coureuse and Scintillation, and did not obtain clear running until passing the 200m.

Scintillation suffered a bleeding attack during the event. As this was the second occasion on which Scintillation had bled the gelding was banned from racing forever (AR53A).

A post-race veterinary examination revealed Oxford Princess was displaying a poor recovery rate and had aggravated an old wound to the near-side hip. A swab sample was taken. Mr P. Sutherland trainer of Oxford Princess, which raced disappointingly, stated that subject to a full veterinary examination it was his intention to recommend that Oxford Princess be spelled. The inquiry was adjourned pending that advice.

RACE 5: Fairfield RSL Club Grey Stars Handicap 1300m:

Close to the finish line A Deena had to steady from the heels of Cariboo.

An inquiry into the reason for Sacra Clause being checked and A Deena being crowded near the 1100m was adjourned to later in the day.

C. Brown (Cariboo) was found guilty of a charge of careless riding under AR137(a) in that he permitted his mount to shift in when insufficiently clear after passing the 1200m resulting in A Deena being crowded in onto Sacra Clause, which lost its rightful running.

C. Brown's licence to ride in races was suspended for a period to commence on 25/8/02 and to expire on 6/9/02 on which day he may ride.

Gillespie was slow to begin.

Halls Of Assembly, Danyon and Midnight Avenue were held up for runs in the early part of the straight.

Passing the 200m Gamesman was struck across the nose by the whip of C. Munce (Master Pom).

A post-race veterinary examination of Gamesman did not reveal any abnormality.

When questioned regarding the performance of Gamesman, L. Beasley stated that he had to make a good deal of use of his horse, which was having its first start for four weeks, to get across and obtain a forward position and as a result Gamesman did not run out the 1900m journey.

When questioned regarding the disappointing performance of Master Pom, C. Munce stated that today the gelding was unsuited when it was under early pressure to lead and under its big weight of 60kgs the effort in his opinion took its toll.

RACE 8: Sydney Markets / Lidcombe RSL Superfecta 1300m:

Approaching the first turn Brantwood Manor, when being checked off the heels of Sammuka, shifted out taking Pourquoi and Georgie Boy wider.

At the entrance to the straight  The Man was inclined to lay in behind the heels of Pourquoi.

More Appeals After Waterhouse Findings Handed Down

{SCPinterestShare href=https://www.virtualformguide.com/racing-news/new-south-wales/21168--sp-1012204440.html layout=standard image=https://www.virtualformguide.com/images/stories/new_south_wales.gif desc=Licensed bookmaker Rob Waterhouse today had his 12-month disqualification reduced to a 9-month suspension by the Appeal Panel.A total of... size=small}
Licensed bookmaker Rob Waterhouse today had his 12-month disqualification reduced to a 9-month suspension by the Appeal Panel.

A total of $78,000 in fines was also reduced to $1,500 on each of 13 charges – a total of $19,500 – but Mr Waterhouse will still be heading to the Racing Appeals Tribunal having lodged an appeal against both decisions.

The 9-month suspension stemmed from Charge 16 in the "Extravagant Odds Affair", which Mr Waterhouse was charged with engaging in conduct which, in the opinion of the Stewards, was prejudicial to the image of racing.

Appeal Panel Chairman, Mr Tom Hughes, AO QC, said that Charge 16 is a serious charge and the Panel’s view is that a monetary penalty would not be adequate. Nor would a period of disqualification be justified.

"In dealing with Charge 16, we must bear in mind the principles of totality and the decision is a period of suspension of nine months from today must be served."

In relation to Charges 1-13 (13 breaches of Local Rule 91(q) – entering into betting records, transactions which were not legitimate wagers), the Panel also decided on a penalty reduction.

"The Panel has concluded that 13 individual fines were too severe a penalty. We must have regard to the principle of totality.

"Each of the charges arose out of the same stupid arrangement. Therefore, we have made the fines $1,500 on each count."

Late today Mr Waterhouse applied to the Racing Appeals Tribunal’s, Judge Perrignon, for a ‘Stay of Proceedings’ seeking to allow the bookmaker to continue fielding.

The Judge has indicated that he will hand down his decision on a Stay of Proceedings before midday tomorrow (Saturday, 17 August 2002).

The NSW TRB has already lodged an appeal against Charge 15 (Misleading evidence relating to Mr McCoy’s address) to the Racing Appeals Tribunal.

"Yes, we have a way to go yet," TRB Chief Executive, Mr Merv Hill, said in summing up today’s proceedings.

When asked: "Are you disappointed that the Appeal Panel watered down the fines and the disqualification was reduced to a suspension" - Mr Hill replied: "I don’t think it’s for us to be disappointed, satisfied or otherwise.

"This is the course of the disciplinary system, so the whole issue isn’t settled yet and it’s a matter of letting it take its course."

App B Hull (MAYBE KATE) pleaded guilty to a charge of careless riding (AR 137 (a)) in that near the 900m he permitted his mount to shift in when insufficiently clear of THE BOOK BINDER which was crowded onto MODENA MODENA which was checked. B Hull’s permit to ride in races was suspended for a period to commence on Saturday 24 August, 2002 and to expire on Saturday 31 August, 2002 on which day he may ride. Near the 900m COSMIC JESS was steadied when crowded by SLEW O’NUGGETS (K Watling) which shifted in. K Watling was severely reprimanded. When questioned G Ryan (COSMIC JESS) explained that after striking interference near the 900m his mount raced further back than intended. He added that he commenced to place his mount under some pressure near the 600m and under full pressure near the 350m. He added that he was obliged to steady away from the heels of SLEW O’ NUGGETS which shifted out near the 200m. He added that after this COSMIC JESS ran on only fairly. G Ryan was advised that in the opinion of the stewards he should have made a greater effort to place his mount under more pressure at the 600m in order to be closer to the leaders at the 350m. He was further advised that he would be expected to ride in mounts in such a manner as to leave no room for query. A post race veterinary examination of COSMIC JESS did not reveal any obvious abnormality.

r6lonhro2.jpg (12423 bytes)Saturday's Group Two Premiere Stakes at Rosehill in Sydney has lost some of its gloss after the champion Lonhro was not among this morning's acceptances.

The Premiere now has a final field of nine headed by the evergreen middle distance performer Shogun Lodge.

Melbourne based heavyweight rider Patrick Payne is expecting a good run from the gelding who has drawn the inside barrier.

"He is going great," Payne said of the gelding he rode for the first time in a gallop between races last Saturday. "He felt terrific."

Justin Sheehan will ride the Graeme Rogerson trained Century Kid in the $141,200 event. The pair will jump from barrier three.

Meanwhile, Simon Marshall's comeback after a five year absence takes another step on Saturday when he rides in his first black type event. He will ride the Noel Mayfield-Smith trained Kaapgun in the Premiere.

Near the 1000m Waaria became unbalanced when racing tight to the inside of Unbridled’s Jest.

Near the 500m Waaria was momentarily crowded for room by Ace Nelson.

Stylish Butterfly was unable to obtain clear running rounding the home turn and in the early part of the straight.

Shortly after straightening Cooper’s Magic was steadied when disappointed for a run between Winter Fun and Chinta Ria (A. Gibbons) which shifted in when not quite clear. A. Gibbons was severely reprimanded.

Unbridled’s Jest was inclined to lay in under pressure in the straight and proved difficult to ride.

RACE 2: Amarda Holdings Global Gaming Industries Plate Fillies & Mares Maiden (Div 1) 1200m:

Groucho Miss was slow to begin.

Emmalegend, which was slow to begin was bumped by In Red which shifted in.

Emmalegend and Roxbury Lass had difficulty obtaining clear running until after the 200m.

RACE 3: Tyrrell’s Wines Plate Fillies & Mares Maiden (Div 2) 1200m:

Zilia bled for the second time during the running of this race and is now barred from racing in Australia forever.

After arriving behind the barriers it was noted that Bonnet Bay had lost it’s near fore plate and as it was unable to be refitted, permission was granted to race the filly bare footed in front.

Bonnet Bay was slow to being.

Foxabel over-raced in the middle stages.

Minikin shifted out under pressure in the straight.

RACE 4: Sky Channel BOC Gases Plate Entires & Geldings Maiden 1200m:

Gobi, Monte Grande and Hotter Than Hell were slow to begin.

Gobi which pulled hard in the early stages improved quickly to the inside of Hyped Up near the 1000m and was steadied when than horse shifted in.

After straightening Oblique was steadied and shifted to the outside of the heels of Blue Patriarch in order to obtain clear running.

RACE 5: Aristocrat Technologies Hcp Class 4 1300m:

When questioned D. Spriggs (Road To Dance) explained that after travelling inside Balancing Act he elected in the early part of the straight to wait for a run to the inside of that horse as he believed it was not in the best interest of the gelding, in view of his big weight, to steady back and come around that runner. He added that on two occasions in the early part of the straight a run briefly appeared however Road To Dance was unable to sprint quickly enough to take advantage of that run and consequently he raced in restricted room in the straight and was unable to fully test the horse.

RACE 6: Ainsworth Game Technology Hcp Class 2 1200m:

After the race it was noted Sounds Supreme had suffered a bleeding attack.

Oak Ridge Lass jumped awkwardly and lost ground.

In the early part of the straight Hot Sort had a tendency to lay in under pressure.

RACE 7: Tooheys Ltd Illawarra AHA Cup Provincial Class 4 Plate 1600m:

Near the 1200m Anglers Arms and Baroncelli dipped.

Near the 900m Respect shifted in momentarily resulting in Chief Arpad having to be steadied.

Shortly after straightening Baroncelli was crowded by Mark of Power (T. Jones) which shifted out to improve. T. Jones was advised to exercise more care.

Fire Wood had some difficulty obtaining clear running in the early part of the straight.

Trainer Mr E. Takacs (Chief Arpad) which raced back in the field, explained that while the gelding at it’s most recent start at Kembla Grange on 3 August went forward without being pressured, contrary to the pre-race plan, today the instructions were consistent with those issued on that day, to ride the horse with cover. Mr Takacs was reminded of his obligation to inform stewards of any change in riding tactics.

RACE 8: Carlton & United Breweries Plate Provincial Class 1 2000m:

Stewards considered an objection lodged by Mr G. Hall, Trainer of 3 rd place getter against Misfits (S. Pollard) being declared the winner of the race on grounds of alleged interference near the 100m. On the evidence it was found that inside the 100m Disarray was steadied and shifted in across the heels of Misfits which shifted out abruptly under pressure. As the Stewards believed that had the interference not occurred that Disarray would not have finished ahead of Misfits they dismissed the objection. S. Pollard was advised that in similar circumstances he must stop riding and straighten.

After making heavy contact with Misfits shortly after straightening, Dazzling Gold became unbalanced, shifted out and bumped King O’ The Rings.

When asked about the improved performance of Misfits, Trainer Ms Diane Poidevin-Laine explained at the horse’s most recent start at Nowra on 9 August the mare had settled back in the field as expected but that when the pace quickened in the middle stages Misfits was unable to quicken and got out of its ground before making ground in the straight. She added a better showing was anticipated today over the longer distance.

Desert Heights which had been held up had to be checked when disappointed for a run near the 100m between Misfits and Stop The Show (G Williams) which shifted out slightly. G Williams was advised to exercise more care.

Desert Heights was then unable to obtain clear running for the remainder of the straight.

RACE 9: Duncan Mackay Farewell Hcp Class 1 1400m:

Jetball gelding Conair is on track for the $153,200 Wyong Gold Cup on September 5, after a runaway win in today's Gold Cup Prelude at the same track.

The Gerald Ryan trained seven-year-old made today's $20,000 event over 1600 metres a one act affair, setting a race record in his three and a quarter length success.

Starting at $7.50, Conair proved much too good for the $5.50 chance Space Age, while Trackball ($9) was third. The $3.20 favourite Desert Brigadier could managed to finish only sixth.

Conair covered the 1600 metres in 1 minute 39.95 seconds, a new race record time, and was ridden by the Sydney premiership winning rider Corey Brown.

The Wyong Rugby League Club Wyong Gold Cup (2100m) will be run in three weeks time and today's winner is exempt from the ballot along with the winners of the Taree and Coffs Harbour Cup and the winners and placegetters of the Spring Quality and Premier's Cup in Sydney.

Near the 450 metres PORTEOS was steadied away from the heels of MADAM ARCHWAY, which shifted in when disappointed for a run to the inside of CANSPRINT. When questioned on the performance of RAW ENERGY, rider J. Nisbet stated that he was instructed to settle the gelding off pace, if at all possible. He added that, after finding cover in the early stages of the event, he elected to allow RAW ENERGY to stride forward when runners to his inside appealed for more room. This resulted in RAW ENERGY racing wide thereafter and disappointing in his opinion. A veterinary examination of RAW ENERGY found the gelding to have bled and Trainer Mr M. Miladinovic was advised of the provisions of AR53A. A veterinary examination of DOMICK PRINCE found that gelding to be badly dehydrated and to have a laceration to the off-hind fetlock.

KINTOREE blundered after the start and was crowded between COMPLETELY STAKAS and SUPERSUE. MISTRAL laid in noticeably throughout. Approaching the 800 metres, KINTOREE, whilst awkwardly placed to the heels of TITLED, shifted out resulting in ALWYN STREET and RUSSIAN MELODY being carried wider on the track. When questioned on the performance of MISTRAL rider M. A. Cahill stated that his mount hung in badly after the start, causing him to be concerned for the riders racing to his inside. He added that, after passing the 800 metres, his mount appeared to race more genuinely but, when placed under pressure after straightening, his mount hung in severely, resulting in him being unable to fully test MISTRAL over the final 300 metres. Trainer Mr S. Hill was advised that MISTRAL must trial to the Stewards’ satisfaction before it would be permitted to race again. A veterinary examination of MISTRAL did not detect any abnormalities. A veterinary examination of COMPLETELY STAKAS found that horse to be mildly distressed and to have a small laceration to its nearside cheek.

BENMANANG and PRINCE PAREE, which were following, were severely hampered and carried wider on the track at approximately 700 metres. After the 700 metres BLUEY’S BULLET (P. Rowe) fell and was later euthanased after fracturing its offside shoulder. P. Rowe was treated by ambulance staff on course and transported to hospital for medical treatment. An inquiry into the reason BLUEY’S BULLET fell was adjourned to a date to be fixed. BABOUCHKE, which was following BLUEY’S BULLET, was severely inconvenienced in consequence. When questioned on the performance of DANCING DIAMOND Apprentice C. Karakatsanis stated he was instructed to race in a handy position but was unable to do so when his mount was slow to begin. He added that, as a result of drawing an inside barrier, he attempted to improve along the rails where possible and shifted wide on straightening to obtain clear running where his mount found the line well. Stewards noted Karakatsanis’ explanations.

The ongoing Robbie Waterhouse "odds for mates" betting saga continues tomorrow morning.

The New South Wales Thoroughbred Racing Board (NSW TRB) have advised that the next stage of the appeal will be conducted at 10am tomorrow.

Waterhouse is locking horns with officials after he offered odds of 500/1 about a number of gallopers, including favourites, to Peter McCoy.

The TRB banned Waterhouse for two years and handed out many thousands of dollars worth of fines, but Waterhouse has subsequently successfully appealed against two of the 14 charges.

Since those charged were upheld the TRB has said they are likely to appeal the result of Waterhouse's successful appeal.

SUPPLEMENTARY: WYONG, 25 JUNE 2002 – Race 6: Media Cup Class 1 Handicap 1100m

An inquiry into apprentice M Cant being dislodged from Kapitza after the winning post was concluded today. Shortly after the winning post Gigabyte Maiz shifted out away from Life’s Fortune, which rolled out slightly at the same time as Power Play, which was racing greenly, shifted in abruptly. Kapitza, which was racing between these two runners, was tightened for room, clipped the heels of Gigabyte Maiz and blundered dislodging apprentice M Cant. As the stewards were not satisfied that any one rider was responsible for the incident, no action was taken other than to remind all riders to ensure they leave sufficient room at all times.

RACE 1 – Shed Enterprises Pty Ltd Maiden Handicap 1100m

Mr L Tilley, trainer of Riviera Playboy, was advised that a warning would be placed on the gelding’s barrier manners as it proved difficult to load.

RACE 2 – Challenger Life Maiden Handicap 1350m

Passing the 100m Star Sorcerer had to be checked off the heels of the tiring Silent Encounter.

When questioned regarding Silent Encounter leading today, R M Quinn stated that he was instructed to go forward as the horse was stepping up in distance and with the addition of blinkers it was felt Silent Encounter would be better suited racing in a forward position. He said the horse travelled well after not having to work too hard to lead but with the blinkers was inclined to race keenly in the middle stages and after straightening failed to respond to his riding and was disappointing in the run home. Mr P Dowsey, representing trainer J Hawkes, confirmed the instructions and was advised that in future he must inform the stewards of any proposed change in riding tactics.

A post race veterinary examination of Silent Encounter did not reveal any obvious abnormalities.

When questioned R Thompson (Cuvanna) explained that approaching the 500m he was of the opinion that Majestic Design would take him into the race and therefore approaching the 450m he was reluctant to shift to the outside of that horse and cover extra ground. He said shortly thereafter Magilas improved quickly to his outside and he was unable then to shift to the outside of Majestic Design despite his efforts and as a result was obliged to check off that horse’s heels and from that point to the 100m he had difficult obtaining clear running. R Thompson agreed he had erred in not shifting to a position to the outside of Majestic Design when the opportunity became available. R Thompson was reprimanded and told that his ride at that particular point lacked initiative and in future similar rides may not be condone. Trainer C Conners stated that in his opinion R Thompson had erred in not coming to the outside of Majestic Design and that there had been moderate support by the stable.

RACE 3 – Cook Care Group Class 2 Handicap 2100m

Arduous King jumped away awkwardly.

Miss Romance stood flatfooted at the start and lost ground.

As the gates were released Spinnaker bounded in the air and lost considerable ground.

Spinnaker then overraced in the early and middle stages and went forward at the 1000m.

A post race veterinary examination of Genoese revealed the mare to be lame in the near fore fetlock. Trainer D Smith was advised that a veterinary certificate of fitness must be furnished prior to Genoese being permitted to race again.

RACE 4 – First Data Resources Australia Class 4 Handicap 1200m

Stewards considered an objection lodged by stipendiary steward Mr C J George on behalf of the connections of the second placegetter Kid Millions against Raid And Rule being declared the winner on grounds of alleged interference near the 100m. on the evidence it was established that approaching that point Raid And Rule shifted out and brushed Kid Millions which became unbalanced. The stewards were of the opinion however that had that interference not occurred that Kid Millions would not have finished ahead of Raid And Rule and in those circumstances the objection was dismissed.

A post race veterinary examination of Lucifer’s Double which, after leading, compounded in the straight, revealed the gelding to have minor lacerations to the near hind fetlock.

RACE 5 – Unicom Credit Union Class 1 Handicap 1350m

Defer stood flatfooted and lost considerable ground. Trainer P Perry was advised that a warning would be placed on the barrier manners of Defer.

Passing the 600m Inclement was tightened for room by Diamond Sun, which was taken in slightly by Classic Flyer (B Pengelly). B Pengelly was advised to exercise more care when shifting ground.

For some distance after the 500m Desert Brigadier was taken back through the field by the tiring Our Midnight Star and did not obtain clear running until straightening.

A post race veterinary examination of Astroflash did not reveal any obvious abnormalities.

RACE 8 –MST Investment Group Class 1 Handicap 1100m

As P Timbery was unable to ride Sky Can Hurri P Losh was substituted. P Timbery will be interviewed.

On jumping Claytons was steadied when crowded for room by Ode To Thee which was taken in by Mr Frown.

Passing the 1000m Life’s Fortune had to be steadied off the heels of Mr Frown, when Life’s Fortune was inclined to shift out away from Dance The Breeze after being bumped by that horse.

Rounding the home turn Mr Frown was inclined to lay in resulting in its rider having to stop riding and straighten on a number of occasions.

Over the final 100 metres Claytons experienced difficult in obtaining clear running.

C Brown (Ode To Thee) was reprimanded for permitting his mount to shift out when not quite clear of Bounty Niaga passing the 300m resulting in that gelding being steadied.

B Pengelly (Bounty Niaga) stated that at the gelding’s last start at Gosford on 2 August 2002 it led easily, however today showed no early gate speed and got further back than he had anticipated.  A post race veterinary examination of Bounty Niaga did not reveal any obvious abnormalities.
